PHASE 1: Report analyses of the compliance of earlier completed overhaul / reconstruction designs with the respective legal framework:

In this phase, review of the existing conceptual designs / preliminary solutions for railway sections Maglaj – Jelina and Zenica – Podlugovi, and for previously completed main designs for railway sections Doboj – Maglaj, Jelina – Zenica – Zenica Station, and Podlugovi – Rasputnica Miljacka, including Traffic studies, pre-feasibility studies and preliminary environment impact assessments for the respective railway sections shall be performed.

On the course of this Phase, the contractor shall check consistency of technical requirements and standards applied on the existing documents and suggest activities, in particular concerning the exiting main designs, needed to have balanced approach and equalised technical requirements and standards.

All potential incompliances shall be addressed and noted, so rectification of such shortfalls would be possible in the following Phases of project implementation.

PHASE 2: Study on Optimisation of interventions and alignment, overhaul / reconstruction / constructions interventions and collisions with roads, and re-adjustment of the road network colliding with the railway:

This Study shall consider more detailed analysis of interventions foreseen on railway sections and alignment, and search for possible improvements that would enable additional savings in construction, but also possible improvements in level of service, safety and comfort of ride on the respective railway sections.

PHASE 3: Technical Study:

Technical studies shall be amended, if and where needed, in line with the outcomes of the PHASE 1 and PHASE 2, above.

PHASE 4: Traffic Study:

Traffic studies shall be amended, if and where needed, in line with the outcome of the PHASE 1 and PHASE 2 above, and more recent traffic data recorded by respective railway infrastructure managers and / or undertakings.

PHASE 5: Pre-feasibility Study:

Pre-feasibility studies shall be updated in line with the outcomes of PHASE 1 to PHASE 4, above.

PHASE 6: Detailed Geodetic Survey:

The contractor shall perform appropriate geodetic survey for the most favourable variant of interventions optimised in the previous phases. The survey shall enable the contractor to prepare adequate terrain layouts, including all specific points of importance for creating a design compliant with reality of the terrain and facilities on the route,· avoiding any substantial deviations to disrupt construction activities. The content and the scale of plans and maps to be delivered shall be in accordance with legislation and regulations of Federation of BiH and Republika Srpska, as well as railway regulations, respectively.

PHASE 7: Geophysical and Geotechnical Investigations and surveys:

The contractor shall perform geophysical and geotechnical investigations along the railway section(s) alignment, in particular on critical and demanding spots, and based on those investigations prepare a preliminary Geotechnical design in accordance to the legislation of Federation of BiH and Republika Srpska, as well as railway regulations, respectively.

PHASE 8: Preparation of Preliminary Design for the most favourable scope of interventions subject to the updated PF Study:

In this Phase, for the most favourable scope overhaul / reconstruction / construction interventions confirmed as feasible in PHASE 5, preliminary design shall be prepared in accordance with the requirements of the legislative and regulatory frameworks of Federation of BiH and Republika
Srpska, as well as railway regulations, respectively.

PHASE 9: Environment Impact Assessment:

Based on the outputs of the preliminary design, the contractor shall produce environment impact assessment and socio-economic impact assessment on the environment, in accordance with requirements of legal frameworks of Federation of BiH and Republika Srpska, as well as railway regulations, respectively.

PHASE 10: Waste Management Plan:

Based on the outputs of the preliminary design, the contractor shall produce waste management plan in accordance with the requirements of legal frameworks of Federation of BiH and Republika Srpska, as well as railway regulations, respectively.

PHASE 11: Feasibility Study:

Based on the outputs of the preliminary design, the contractor shall produce feasibility study in accordance with the requirements of legal frameworks of Federation of BiH and Republika Srpska, as well as railway regulations, respectively, and the EU and IFis’ requirements.

PHASE 12: Safety Audit Report:

Based on the outputs of the preliminary design, the contractor shall produce safety audit report. This address remedy measures to reduce, or remove such report shall address potential safety risks and risks through the following phases of design.

PHASE 13: Public Consultations:

Based on the outputs of the preliminary design, the contractor shall, in support to local authorities and in accordance with their legal roles, facilitate procedure of public consultations, if and where required due to the new construction foreseen, or substantial reconstruction activities designed. Consultations shall be performed in accordance with the legislations of Federation of Bili and Republika Srpska, respectively, and the potential finance providers, the IFis/the EU Banks. These consultations aim to obtain the consent concerning the reconstruction I construction interventions of the local communities on whose territories the designed interventions shall take place, or take the stock of problems and remediation activities to minimise the negative impact of the railway and maximise its positive impact.

PHASE 14: Compilation of Preliminary Design technical documentation:

The contractor shall compile prepared components of preliminary design and studies in accordance with the legislative and regulatory frameworks of Federation of BiH, Republika Srpska, BiH and the EU regulations, as well as railway regulations, respectively.

PHASE 15: Preparation of Main Design:

The contractor shall prepare main design in accordance with the legislative and regulatory frameworks of Federation of Bili and Republika Srpska, as well as railway regulations, BiH and the EU regulations, respectively. In case of discrepancy, the more strict rules shall prevail and be applied.

The main design shall present a set of coordinated specifications, drawings and designs, which shall determine technical solutions for all technical elements of the railway. The main design shall reflect the requirements for the technical elements, as well as legal frameworks, regulations and requests regarding special requirements to be addressed through the specific conformities and permits.

The main design shall be sufficiently detailed to enable compilation of the tender documentation and execution of works in accordance with the design.

PHASE 16: Land Acquisition and Resettlement Framework (LARF):

Based on the details of the main design, the contractor shall produce Land Acquisition and Resettlement Framework (LARF), if and where applicable, in line with the EBRD PR5. This elaborate shall provide for detailed elements and details on expropriation area, so it would serve as basis for process of land acquisition / expropriation and resettlement of population if and where needed.

PHASE 17: Offprints of obtaining zoning approvals and building permits:

The contractor shall prepare offprints and extracts from the documentation as described in detail in Point 4.2.17. The cost of such intervention(s) is considered included in the global price of the contract.

PHASE 18: Revision of Main Design:

Main design prepared by the contractor shall be subject to revision by the authorized consultancy company(ies) in possession of valid licenses for revision of railway designs, applicable in Federation of BiH and Republika Srpska, respectively.

The cost of such revision of main design shall be at the expense of the contractor and it is considered included in the global price for the assignment subject to the provisions of this Terms of Reference.

PHASE 19: Specific Requirements:

The specific requirements of this ToR are described in detail in Point 4.2.19.

PHASE 20: Preparation of Tender Dossier for overhaul / reconstruction / construction interventions on railway sub-sections, based on the outputs of this assignment:

Based on the revised main design for the respective sub-sections subject to this assignment, the contractor shall compile a tender dossier for launching a works contract(s) for execution of the specific overhaul / reconstruction / construction interventions, separately for each of specified sub-sections, separately for each of the tracks on double-track sub-sections and separately for each specific high scale structure eventually to be designed. This approach shall be maintained in order to enable phased implementation of the project.

The tender dossier shall be compiled in accordance with the procurement procedures of the EBRD (EBRD PPRs dated November 2017 or more recent).
